This Decree regulates the business and management of prize-winning electronic games business for foreigners in the territory of the Socialist Republic of Vietnam; in which, prize-winning electronic game enterprises (enterprises) are only allowed to organize prize-winning electronic games at a single business location licensed to do business by a competent State management agency. according to regulations of the Law.
A business point must fully satisfy the following conditions:
- To be isolated from other business areas of the enterprise and to have its own entrance and exit;
- have electronic equipment and camera system to monitor and regularly monitor all activities in the business point (24/24h).
- The images must be fully archived for at least 180 days from the date of recording and ensure clear images at the following locations: The entrance and exit areas of the business; the area where prize-winning electronic game machines are located; cashier area, treasury for counting cash and conventional currency and storing equipment for cash and conventional currency;
- comply with security and order conditions as prescribed by the law on security and order for a number of conditional investment and business lines;
- have fully posted the entry and exit rules in Vietnamese, English and other foreign languages (if any) at a recognizable position at the entrance and exit of the business point.
The time when an enterprise is allowed to organize business activities is every day of the year, except for days when it is not allowed to operate under the decision of a competent State management agency.
In case the State management agency requests to suspend business operations, the enterprise is responsible for notifying the player of the time of business cessation as soon as the State management agency announces the decision to request the player. suspend business operations.
The number of prize-winning electronic game machines specified in the certificate of business eligibility is based on the total number of accommodation rooms that have been put into business at the accommodation establishment with the rate of 5 rooms. Businesses are allowed to trade no more than 1 prize-winning electronic game machine.
When all prize-winning electronic games are put into business, enterprises must develop game rules suitable to the way they are played, the rate of payout, the specific design of each type of machine, and send them to the Ministry of Finance, the Department of Finance and the Department of Finance. Finance, local Tax Department to track.
The Decree also clearly stipulates that the subjects who are allowed to play at business points are foreigners and overseas Vietnamese who legally enter Vietnam with their passports or international travel documents. issued by a competent foreign authority and has a valid residence permit in Vietnam.
The subjects mentioned above must have full civil act capacity as prescribed by Vietnamese law and voluntarily abide by the game rules and the provisions of this Decree.
Players have the following rights:
- To be confirmed by the business and fully paid when winning;
- be entitled to receive the bonus payment and transfer or bring the bonus payment in foreign currency abroad according to the regulations on foreign exchange management of Vietnam's law and the guidance of the State Bank of Vietnam;
- to request enterprises to keep the winning and receiving information confidential; have the right to complain and sue the enterprise about the reward payment results;
- denounce acts of fraud, violations of this Decree and legal regulations;
- enjoy other legal benefits as prescribed in the game rules announced by the enterprise.
Players have obligations:
- Must bring documents to prove that they are allowed to play;
- be responsible for complying with the game rules, internal rules and regulations of the enterprise's relevant internal management, and fulfill tax obligations to the State as prescribed by law;
- not use the results of the prize-winning electronic games at the point of sale to bet directly against each other;
- must not cause a loss of security, social order and safety at the business premises;
- strictly comply with the provisions of other relevant laws.
The Decree takes effect from February 12, 2022.
